By accessing or using this Site, purchasing products, or utilizing our services, you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully. If you do not agree to these Terms, you must not use this Site.

​1. Eligibility and Age Restrictions

​By using this Site or purchasing any items, you certify that you are of legal age to purchase firearms, ammunition, or related components in accordance with federal, state, and local laws.

• ​Ammunition: You must be at least 18 years old to purchase rifle or shotgun ammunition and at least 21 years old to purchase handgun ammunition.
• ​Firearms: You must be at least 21 years old to purchase handguns, receivers, or certain regulated firearms components, and at least 18 years old for long guns, subject to state and local laws.
• ​By placing an order, you confirm that you are not legally prohibited from possessing, receiving, or purchasing firearms, ammunition, or any items ordered.

​2. Firearms Sales and Shipping Policy

​Fog House Firearms strictly adheres to all federal, state, and local laws regarding the sale and transfer of firearms.

• ​No Direct Shipping: Firearms cannot be shipped directly to an individual’s home. All firearms must be shipped to a valid Federal Firearms License (FFL) holder.
• ​FFL Selection: It is the customer's responsibility to coordinate with their chosen FFL dealer and ensure a copy of the dealer's current FFL license is provided to Fog House Firearms before shipment.
• ​Background Checks: The receiving FFL dealer will perform the required background check before transferring the firearm to you. You are responsible for any transfer fees charged by your local FFL.
• ​Failed Background Checks: If you fail the background check at your local FFL, you are responsible for return shipping costs and a restocking fee.

​3. Ammunition and Regulated Goods

• ​Shipping Restrictions: Ammunition must be shipped via ground transport and cannot be shipped to PO Boxes, APO/FPO addresses, or internationally.
• ​Local Compliance: Certain jurisdictions restrict the online sale and shipment of ammunition, high-capacity magazines, or specific firearm components. It is your absolute responsibility to know your local and state laws. Fog House Firearms will cancel any orders destined for jurisdictions where the item is prohibited.

​4. Product Descriptions and Pricing

• ​We strive to be as accurate as possible with product descriptions, imagery, and pricing. However, we do not warrant that product descriptions or other content on this Site are completely error-free.
• ​In the event of a pricing error or incorrect inventory data, Fog House Firearms reserves the right to cancel any orders placed for that item, even if the order has been confirmed and your payment method charged. If cancelled, a full refund will be issued.

​5. Returns, Refunds, and Cancellations

• ​Firearms and Ammunition: Due to safety regulations and the nature of the products, all sales of firearms and ammunition are final. Once a firearm leaves the possession of the FFL dealer, it cannot be returned to Fog House Firearms.
• ​Other Items: Returns on accessories, optics, or apparel may be accepted within 30 days of purchase, provided the items are unused, in original packaging, and accompanied by proof of purchase. Returns may be subject to a restocking fee.
• ​Order Cancellations: Requests to cancel an order must be made before the item ships. Shipped orders cannot be cancelled and must follow our standard return policy.

​6. Prohibited Activities

​You agree not to use this Site for any unlawful purpose. You are prohibited from:

• ​Using the Site to attempt fraudulent purchases or use unauthorized payment methods.
• ​Engaging in "straw purchasing" (attempting to purchase a firearm on behalf of someone else who is legally prohibited from owning one).
• ​Copying, distributing, or modifying any content, logos, or media from foghousefirearms.com without prior written consent.

​7. Limitation of Liability and Indemnification

• ​Fog House Firearms is not liable for any misuse, illegal handling, or unsafe operation of any firearms, ammunition, or accessories purchased through this Site. You assume all risk and liability for the ownership and safe deployment of these items.
• ​To the fullest extent permitted by law, Fog House Firearms shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Site or products purchased.
• ​You agree to indemnify, defend, and hold harmless Fog House Firearms from any claims, damages, or liabilities arising from your violation of these Terms or local laws.

​8. Governing Law

​These Terms and all disputes arising from your use of this Site or purchases made through it shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles.
